1. Definitions
1.1 “Company” refers to Garden Guys, the provider of garden maintenance, landscaping, and related services.
1.2 “Customer” refers to any individual or entity purchasing services from the Company.
1.3 “Services” refers to garden maintenance, landscaping, irrigation system installation and maintenance, tree felling, and any other related services offered by the Company.
2. Application
2.1 These Terms and Conditions (“T&Cs”) govern all transactions between the Company and the Customer concerning the provision of Services.
2.2 By engaging the Company’s Services, the Customer agrees to be bound by these T&Cs.
3. Quotations and Orders
3.1 All quotations provided by the Company are valid for 14 days unless otherwise specified.
3.2 Orders are subject to acceptance by the Company and availability of resources.
4. Pricing
4.1 Prices are subject to change without prior notice but will not affect confirmed orders.
4.2 Prices include Value Added Tax (VAT) as per South African law.
5. Payment Terms
5.1 Payment is due upon completion of Services unless credit terms have been agreed upon in writing.
5.2 Accepted payment methods include cash, electronic funds transfer (EFT), and major credit cards.
5.3 For credit accounts, payment terms are strictly 30 days from the date of invoice. Overdue accounts may incur interest at a rate of 2% per month.
6. Service Delivery
6.1 The Company will make reasonable efforts to meet agreed-upon schedules but is not liable for delays beyond its control.
6.2 The Customer must provide access to the property and ensure that the area is safe for the provision of Services.
7. Warranties and Liability
7.1 The Company warrants that Services will be performed with reasonable care and skill.
7.2 Any defects in the Services must be reported within 7 days of completion, and the Company reserves the right to inspect and remedy such defects.
7.3 The Company’s liability is limited to the re-performance of defective Services or a refund of the service fee, at its discretion.
7.4 The Company is not liable for any indirect, special, or consequential damages arising from the provision of its Services.
8. Customer Responsibilities
8.1 The Customer must ensure that the property is in a suitable condition for the provision of Services.
8.2 The Customer must provide accurate information regarding the required Services and any relevant property details.
9. Indemnity
9.1 The Customer indemnifies the Company against any claims arising from misuse or improper handling of the Services.
10. Intellectual Property
10.1 All intellectual property rights related to the Company’s branding, materials, and content remain the property of the Company.
11. Governing Law and Jurisdiction
11.1 These T&Cs are governed by the laws of South Africa.
11.2 The Customer consents to the jurisdiction of the Magistrate’s Court, notwithstanding that the amount in dispute may exceed the jurisdiction of the Magistrate’s Court.
12. Amendments
12.1 The Company reserves the right to amend these T&Cs at any time. Updated versions will be made available on the Company’s website.
13. Severability
13.1 If any provision of these T&Cs is found to be invalid or unenforceable, the remaining provisions shall continue to be binding and in full force.
14. Entire Agreement
14.1 These T&Cs constitute the entire agreement between the Company and the Customer and supersede all prior agreements or understandings, whether written or oral.
